Personal Injury

Personal injury cases are many times based on the common law tort of negligence.  In a negligence suit four elements must be proven by a preponderance of the evidence:

     1. Duty - one party had a duty to safeguard the injured party
    2.  Breach of that duty
    3.  Injury - because of the breach a party was injured
    4.  Proximate Cause - the breach of duty must be related to the injuries

In other words, to prove someone is legally responsible for your injuries one must prove that the party causing the accident had a duty to do, or not to do, something; the party failed to do his duty that resulted in your damages, which were directly related to his breach of duty.

If the burden of proof is met you may be able to recover your:

    a.  Medical bills, both past and future
    b.  Lost wages, past and future
    c.  Pain and suffering, past and future
    d.  Punitive damages, (Punitive damages are intended to punish wrongdoers and prevent them from harming others.)
    e.  Interest, and
    f.  Other case specific damages, if any
